The Simple Definition

A tax deed is a legal document that gives ownership of a property to the government (or the highest bidder at auction) when the owner fails to pay property taxes for a certain period. In Florida, that period is two years from the date taxes become delinquent.

How a Property Ends Up at Tax Deed Sale

  1. Delinquency: Property taxes are not paid by April 1 of the year after they are due.
  2. Tax Certificate Sale (June): The county sells tax certificates to investors who pay the delinquent taxes. The certificate holder earns interest (up to 18% in Florida).
  3. Application for Tax Deed: If taxes remain unpaid for two years from April 1 of the delinquency year, the certificate holder can apply for a tax deed.
  4. Notice & Auction: The county gives notice to the owner and publishes the sale. The property is auctioned to the highest bidder.
